GENERAL CONDITIONS OF SALE - HAYANI COLLECTION
1 – Conclusion of the contract
Any order for products implies unreserved acceptance of these general conditions of sale, supplemented or amended by our special conditions, which cancel any contrary clause that may appear in the conditions of purchase, order forms, or other commercial documents.
2 – Price
The goods are invoiced at the price in effect on the day the order is placed. The general price is annexed to these conditions. Prices may be revised subject to 30 days’ prior notice.
3 – Delivery
Delivery is made either by direct delivery of the product to the purchaser, or by notice of availability, or by delivery to a shipper or carrier at the seller's premises or in any other designated premises. Verification of the goods by the buyer must be carried out at the time of their collection. In the event of damage or missing items, complaints about apparent defects or non-conformity of the delivered product, the buyer will issue clear and precise reservations which he will notify within three days following the delivery date. in writing to the seller or carrier. It will be up to the buyer to provide any justification as to the reality of the anomalies observed.
4 – Delivery times
Delivery times are indicated based on supply availability. Except in cases of force majeure (war, riot, fire, total or partial strike.), in the event of a delay in delivery lasting more than 10 days after the indicative delivery date, the buyer will have the option to cancel his order, without being able to claim any compensation whatsoever.
5 – Returns
Any product return must be the subject of a formal agreement between the seller and the buyer. The buyer can exercise their right of withdrawal before 14 days after their purchase. The product must be returned in its initial condition, without signs of degradation, tears, marks or abnormal odor. To return an item, the customer must send the purchase invoice by email to Hayaani.co@gmail.com, they will then have to follow all the steps that they will receive by email. The postage fees are paid by the client. Hayani collection may refuse any return that does not comply with the preceding conditions. In this case, no refund will be made if the conditions are not respected.
The refund will take place within 7 to 14 days after receiving the returned product. Shipping costs will not be refunded, only the price of the items ordered.
Items with promotion cannot be returned, exchanged or refunded.
6 -Guarantee
The seller will take the greatest care in the execution of the order and the quality of the products. In the event of a defect recognized by the seller, the latter's obligation will be limited to the replacement or reimbursement of the defective quantities, without further compensation. Excluded from the warranty are defects and damage resulting from storage, handling, transport or use in abnormal conditions or not in accordance with the nature, requirements or suitability for use of the product.
7 – Payment
Unless otherwise specified, invoices are payable from the delivery date. In the event of late payment, the seller may suspend all orders in progress. Any amount not paid by the due date appearing on the invoice automatically entails the application of penalties of an amount equal to one and a half times1 the legal interest. These penalties will be payable upon simple request from the seller.
8 – Termination clause
In the event of non-payment, forty-eight hours after a formal notice remains unsuccessful, the sale will be automatically terminated by the seller who may request summary restitution of the products without prejudice to any other damages. The amounts remaining due for other deliveries will become immediately due if the seller does not opt for the cancellation of the corresponding orders.
9 – Reservation of title
The goods sold remain the property of the seller until full payment of their price. However, the risks relating to the goods will be transferred to the buyer or the carrier, upon physical delivery of the products.

Loss of packages
In the event of loss of packages, a dispute will be opened with the carrier concerned.
The dispute will then be handled in full before receiving compensation, if any.
In the event of loss or theft of the package, parts will be replaced automatically. Only if the parts are no longer available, the items will be refunded.
If the “private parcel” choice was chosen, despite the fact that the seller was informed of numerous problems that there were with this carrier, the seller is free not to compensate the order in the event of loss or theft of the parcel .
